Dear Provider,

This letter is to inform you of Oklahoma Health Care Authority (OHCA) Developmental Disabilities Services Division (DDSD) policy changes effective May 11, 2007. 

Revisions to Subchapters 3 and 5 of Chapter 30 and Subchapters 5 and 7 of Chapter 40, Title 317: 1) clarify DDSD Home and Community-Based Services (HCBS) Waiver program provisions; 2) clarify habilitation services; 3) delineate levels of support criteria in agency companion services; 4) reflect current group home provisions and requirements; and 5) provide contracting guidelines for HCBS Waiver service employment.

 

  • 317:30-3-40 of Part 3, 317:30-5-410 through 317:30-5-412 of Part 41, and 317:30-5-480 and 317:30-5-481 of Part 51 are amended to clarify HCBS Waiver program provisions.
  • 317:30-5-482 of Part 51 is amended to better delineate habilitation services, including employment services.
  • 317:40-5-3 of Part 1 is amended to clarify levels of support criteria in agency companion services.
  • 317:40-5-152 of Part 11 is amended to specify community living homes may serve no more than 12 persons and reference relevant policy cites.
  • 317:40-7-8 and 317:40-7-18 are amended to clarify employment training specialist services and contracts with industry, including guidelines for the employer.
