4-10 Merit Protection Commission Appeals   (Confidential Record 12 O.S. §2502)
Description: File consists of adverse action appeals and alleged violation appeals filed by OKDHS employees, former employees, or applicants with the Oklahoma Merit Protection Commission pursuant to 74 O.S. §840-6.5, 74 O.S. §840-6.6, or 74 O.S. §840-2.5. These include administrative pleadings, orders, exhibits, and discovery material, along with privileged attorney client communications, witness interviews, and trial preparation material.
Volume: seven (7) cubic feet per year
Disposition: Retain in office until two (2) years after conclusion of matter, including any judicial review pursuant to the Administrative Procedures Act, then transfer to records storage. Retain in  records storage for five (5) years, then destroy, provided no legal or administrative proceedings are pending requiring continued preservation and the Legal Division or the Attorney General have not initiated a litigation hold upon destruction, provided records meet all stipulated retention requirements, and approval to destroy records has been received from the State Records Administrator. 

In the event of litigation, consolidate with litigation file and treat as litigation file for permanent preservation, Series 4-9.
