Description:
File includes duplicate copies of charges filed with the OHRC or EEOC by employees or applicants, the agency Position Statement, and supporting evidence provided to the administrative agency or gathered for investigative purposes to assist in creating Position Statement. This file will include confidential attorney-client communications. The agency office of records is the Office of Civil Rights, Schedule 2005-03, Series 1-4 through 1-6.

four (4) cubic feet per year
Disposition:
Retain in office until two (2) years after conclusion of matter, then transfer to records storage. Retain in records storage for five (5) years, then destroy provided no legal or administrative proceedings are pending requiring continued preservation and the Legal Division or the Attorney General have not initiated a litigation hold upon destruction, provided records meet all stipulated retention requirements and approval to destroy records has been received from the State Records Administrator.
In the event of litigation, consolidate with litigation file and treat as litigation file for permanent preservation in Series 4-9.
