Homeward Bound v. The Hissom Memorial Center Class Action Suit
6-24 Hissom Memorial Center Client Records-ActiveRecords  
Description: File contains medical records such as nursing notes, physician notes, direct care notes, medical consultations, dental summaries, and laboratory and x ray reports. The file also contains therapeutic reports, such as occupational, physical, and speech therapies and reports done by Social Service, Psychology, and Education social workers.
Volume: two hundred fifty (250) cubic feet per year
Disposition:

Retain in file until they become three (3) years old, then transfer to records storage.  Retain in records storage until twenty-five (25) years after last contact with client or after the client has died, then destroy provided: (a) all audits have been completed and all applicable audit reports have been accepted and resolved by all applicable federal and state agencies; (b) no legal actions are pending and (c) permission to destroy records has been received from the State Records Administrator.  If legal action is pending, destroy seven (7) years after exhaustion of all legal remedies provided records meet all stipulated retention requirements and permission to destroy records has been received from the State Records Administrator.  

OR 

Retain in office until they become three (3) years old then transfer records to an electronic format.  Destroy hard copy documents, except those that cannot be reproduced in a legible and readable condition, upon certification that all records have been successfully entered into an electronic format, after storing an electronic backup copy in an off-site storage area that meets manufacturer’s recommendations for temperature and humidity controls, and after obtaining approval from the State Records Administrator to destroy the hard copy documents.  

Delete electronic records and destroy all below standard documents twenty-five (25) years after last contact with client or after the client has died, provided all audits have been completed, all applicable audit reports have been accepted and resolved by all applicable federal and state agencies, no legal actions are pending, and approval to destroy records has been received from the State Records Administrator.  If legal action is pending, delete seven (7) years after exhaustion of all legal remedies, provided records meet all stipulated retention requirements.
