2-4B Investigative Case Files--Prosecuted   (Confidential Records)
Description:

Files contain information as described in Series 2-4A for cases accepted for prosecution by the district attorney.

Disposition:

Copy file and transfer original to district attorney for prosecution. Retain file copy until no further legal action is pending and the case has been closed, then transfer to the OKDHS Records Center or the State Records Center. Retain in the OKDHS Records Center or the State Records Center five (5) years, then destroy provided permission to destroy records has been received from the State Records Administrator.

See: OAC 340:2-7-5(c), or equivalent and all subsequent revisions, for determining cases which are and are not prosecuted.
