2-44 Public Assistance Records (Inactive-Overpayment Cases with Payments Outstanding)   (Confidential Record 56 O.S. §183 and 45 CFR §205.50)
Description: Files contain information relating to overpayment or restitution owed to the agency by client or estate of deceased client that has payments outstanding.
Disposition: Retain in files three (3) years after case closure, then transfer the county overpayment section to the State Office, Central Records when the overpayment debt is still outstanding or status of overpayment is unknown. Destroy remaining sections of the case file provided: (a) all audits have been completed and all applicable audit reports have been accepted and resolved by all applicable federal and state agencies; (b) no legal actions are pending; and (c) approval to destroy documents has been received from the State Records Administrator or his/her designee. If legal action is pending, destroy two (2) years after exhaustion of all legal remedies provided records meet all stipulated retention requirements, and approval to destroy records has been received from the State Records Administrator.
