Public Assistance Records

| Description: |
Case files relating to departmental programs in the areas of aid to the aged, aid to the blind, Temporary Assistance to Needy Families (TANF), aid to the disabled, medical assistance (including Oklahoma Department of Human Services and Office of Juvenile Affairs custody medical), food stamp program, refugee assistance program, emergency assistance program, and Low Income Home Energy Assistance Program (LIHEAP).

Retain in office until three (3) years after closure, then destroy provided all audits have been completed and all applicable audit reports have been accepted and resolved by all applicable federal and state agencies and provided no legal actions are pending and approval to destroy records has been received from the State Records Administrator. If legal action is pending, destroy two (2) years after exhaustion of all legal remedies, provided records meet all stipulated retention requirements, and approval to destroy records has been received from the State Records Administrator.
OR
Retain in office and transfer records to an electronic format. Destroy hard copy documents except those that cannot be reproduced in a legible and readable condition upon certification that all records have been successfully entered into an electronic format. Maintain a backup copy in a storage area that meets the manufacturer's recommendations for temperature and humidity controls.
Delete electronic records and destroy all below standard documents three (3) years after closure, provided all audits have been completed, all applicable audit reports have been accepted and resolved by all applicable federal and state agencies, no legal actions are pending, and approval to destroy records has been received from the State Records Administrator. If legal action is pending, destroy two (2) years after exhaustion of all legal remedies, provided records meet all stipulated retention requirements. Amended January 26, 2006
