340:100-3-8. Client work

     Clients who perform work are compensated according to provisions of the Fair Labor Standards Act (FLSA) as amended.
  • (1) No client will be required to perform labor which involves the operation and maintenance of a facility without proper compensation except as it relates to the client's habilitation plan. When appropriate, residential staff shall be responsible for training programs designed to teach residents to clean and maintain their own living areas. Other household duties (chores) may be assigned to the residents on a rotational basis, provided the duties shall be in keeping with normal routines of daily living and not for the convenience of staff or as work for the residence. Regular participation in activities such as meal planning, food purchase, dishwashing, laundry, housekeeping, etc., that leads to the resident's greater functional ability (independence) is not considered work for the residence.
  • (2) All client work will be performed as an integral part of or is incorporated within the client's habilitation plan.
