340:75-19-21. Reports of abuse or neglect of children in tribal foster resource care

(a) Reports of abuse or neglect of either DHS or tribal custody children placed in tribal foster homes are handled in accordance with OAC 340:75-3-8.1.  • 1 & 2

(b) Tribes make all decisions about the removal from or the return to the tribal foster home for children in tribal custody.  DHS makes all decisions about the removal from or return to the tribal foster home for children in DHS custody.

INSTRUCTIONS TO STAFF 340:75-19-21

 

1.  Refer to OAC 340:75-3-8.1 regarding the protocol for addressing Child Protective Services (CPS) reports in foster or trial adoptive homes.

2.  The Child Welfare (CW) worker notifies the tribe immediately of any report of abuse or neglect of a child in a tribal foster resource home and requests the tribe's participation in the investigation or assessment.
