340:75-1-24. Child Welfare - direct service

(a) Definition of a family.  A family is one or more adults and children, if any, related by blood or law, and residing in the same household.  Service eligibility status of children living with persons not legally responsible for their care is determined as though the child was a one person family.

(b) Request for direct services.  All families and children have the right to receive Child Welfare (CW) services provided within the scope of the program.  Information is provided about what services are available or assistance is given in clarifying the areas  where help is needed.  Requests for service may be made by the applicant, an authorized representative, or someone acting on the applicant's behalf.  Each request for service is handled promptly and courteously.   • 1 & 2

INSTRUCTIONS TO STAFF 340:75-1-24

 

1.  Walk-in appointments.  Requests made in person at the local office are accepted without appointments.  In situations where the Child Welfare (CW) worker or supervisor is not available, a worker designated by the county director responds to the request.

2.  Requests for CW services.  Reports of child abuse or neglect are considered as requests for CW services.  The CW worker offers services as indicated.  Examples of requests for direct service are:

  • (1) completion of Form DCFS-46 (new form number 04FC007E), Authorization from Parent or Guardian for Voluntary Foster Family Home Placement and Medical Care of Child, or Form DCFS-46-A (new form number 04IL001E), Voluntary Placement Request.  If circumstances prohibit the applicant or individual requesting voluntary services from signing Form DCFS-46 (new form number 04FC007E), the worker enters the reason for the failure of the client to sign the form and the date the request for service was made.  In the event an applicant withdraws the request for voluntary services, cannot be located, or fails to cooperate in providing the necessary information, this is documented and the appropriate action is taken in KIDS to close out the referral and/or case;  
  • (2) a phone report, in-person report, a letter, or a news report of abuse, neglect, or exploitation; and
  • (3) a court order.
