340:40-7-3. Age requirements

(a) A child is eligible for subsidized child care benefits through the day before he or she turns 13 years of age.

(b) A child with disabilities may be eligible to receive subsidized child care benefits through the day before he or she turns 19 years of age.

  • (1) A child with disabilities is defined at OAC 340:40-7-3.1.
  • (2) When a child with disabilities is 13 or older, the client must provide a statement from a licensed health care professional verifying that the child is physically or mentally incapable of self care as age appropriate before care is approved and annually at review.  If the licensed health care professional states that the child is capable of self care as age appropriate, care is not approved.

(c) A child under court supervision may be eligible to receive subsidized child care benefits through the day before the child turns 19 years of age.  When the child is 13 or older, the client must provide a copy of the court order, a statement from the Child Welfare worker, or the Office of Juvenile Affairs (OJA) worker verifying this before care is approved and annually at review.
