Chairman DeVaughn called the meeting to order.

Oklahoma Department of Human Services Director Howard H. Hendrick began his comments to the Commission by listing some recent site visits that included child welfare reviews, multiple Legislative meetings regarding OKDHS budget issues and legislation, Oklahoma Supported Employment Conference for persons with developmental disabilities, presentation on providing Medicaid waiver services to persons with Traumatic Brain Injuries, OCCY committee meeting regarding training needs of the legal profession for child welfare cases, 2007 State Charitable Campaign Awards Ceremony (OKDHS was the largest contributing agency with record donations of $84,183), Wellington Assisted Living Center crowning of Ms. Wellington 2007, Black Heritage Celebration 2008 at Greater Mt. Olive Baptist Church, Data Services Division Help Desk open house, Oklahoma County Continuous Quality Improvement Initiative at 55A, multiple 90 day reviews, Child Care policy review and quality improvement planning session, Governor’s Mental Health transformational advisory board, Council on Aging March 2008 meeting, OK Partnership for School Readiness Board meeting, 2008 Partners Conference, Policy and Practice Series lecture by Dr. Robert Cox from the University of Oklahoma discussing European Welfare Systems, Oklahoma County Juvenile Court planning session, OCCC planning session for a new child development center to deliver student scheduled child care, multiple budget review and planning sessions, Oklahoma Capitol Improvement Authority meeting, annual meeting with CASA directors from across the state, State Insurance Department planning session for surveying access to insurance for low income working families, status of and planning for the continuation of a Microsoft remanufacturing plan for used computers, TCW and cost allocation planning session, APHSA Spring Conference, Governor’s Developmental Disability Employment Awards, Facilities Management Unit’s Quarterly planning session, CDRB Media Campaign Release event, Child Support Enforcement special allocation rules planning session and the Department of Commerce Agency Directors’ planning session for Workforce Development.

Next, the Director shared some good news about the Microsoft Authorized Refurbisher recognition. The OKDHS PC Donation program is the largest government-based Microsoft Authorized Refurbisher (MAR) program in the United States with 4,000 PCs being refurbished and redistributed to non-profits to date. OKDHS is also the 18th largest distributor in the twenty-year history of the program. The only government-based program MAR that is larger is the program from the Columbian government.

Director Hendrick next spoke briefly about the current economic situation in America and Oklahoma before outlining some of the 2009 fiscal year budget challenges facing the agency.

The Director next delivered a brief Food Stamp update before discussing some major issues ahead, such as sorting through the various funding challenges to determine which budget cuts will be realized and which can be avoided to begin to prepare for the challenge of constructing the SFY 2009 budget. Continuing to prepare improvement plans for our Child Welfare services and finishing a proposed resolution for the agreements and services delivered by the LTCA of Tulsa for future services.

OKDHS Chief Financial Officer Phil Motley presented the financial reports for the period ending Feb. 29, 2008. Operational receipts and receivables, for 2008 remain strong at only 3.5 percent less than year to date expectations at the end of February. Through the same period, operational expenditures and payables for current year are 4.9 percent less than the year-to-date budget. This represents approximately $57.7 million of unspent budget. However, almost $50 million of this under performance is unearned federal dollars. Consequently, the unutilized state dollars represented by this level of spending through last month is approximately $7.8 million. Prior year available cash remained materially unchanged from the previous month at a little more than $6.7 million. The prior year cash and the unused year-to-date state dollars produce about $14.5 in positive financial position. The available carry over into FY09 is currently projected to be around $7 million short of the carry over obligated in the current FY08 budget.

The Aging Services Division through February is over budget by 3.9 percent through month end. All other divisions are within their respective aggregate budgets. Three agency programs are over budget through the reporting month.  Group Homes and Shelters in the Children and Family Services Division are over budget by 2.9 percent. Aging Services Division has two programs now reported over budget. Personal Care State Office is reported over budget by 1.2 percent and is due to staffing issues. The ADvantage Program is now over by 11.9 percent through last month.

Another 122 Adoptive Placements were completed in February. The number of Children in Foster Care decreased for the sixth consecutive month in February by 26 children. Food Benefit cases increased by 3,866 during the month. TANF Child Only Cases declined by 88 and TANF Cases with Adults dropped by 143 in the past month.

SUMMARY: The proposed revisions to Subchapter 10 of Chapter 105 amend the rules to:  (1) comply with the Older Americans Act, as amended in 2006 (Public Law 109-365), including definitions of terms, eligibility for the National Family Caregiver Support Program (NFCSP), clarification of services available, and clarification of the target population to be served; (2) include recent amendments to the State Council on Aging By-laws increasing the number of members from 29 to 31 and add to the list of entities eligible for membership; and (3) comply with Section 1247 of Title 21 of the Oklahoma Statutes (21 O.S. § 1247) requiring public facilities be smoke free.

  • 340:105-10-3 is amended to comply with 2006 Reauthorized Older Americans Act (OAA) revisions that update and clarify definitions used by OAA Title III programs.
  • 340:105-10-12 is amended to reflect recent amendments to the State Council on Aging By-laws that increase the number of Council members from 29 to 31, clarify titles of entities that submit nominees for membership to the Council, add the Oklahoma Health Care Authority to that list, and increase the number of at-large members nominated and appointed to the Council from eight to nine.
  • 340:105-10-13 is amended to reflect updated language of OAA 2006 revisions adding to list receiving preference those individuals at risk for institutional placement and older individuals with limited English proficiency.
  • 340:105-10-32 is amended to add family caregivers of participants or eligible participants to the required composition of area agency on aging advisory councils.
  • 340:105-10-36 is amended to reflect for-profit applications to provide an OAA Title III service must be approved by the State Agency.
  • 340:105-10-37 is amended to include the requirement to coordinate with the State Agency and the Oklahoma Department of Mental Health and Substance Abuse Services to increase public awareness of mental health disorders, remove barriers to diagnosis and treatment and to coordinate mental health services and to coordinate with trained volunteers as stipulated in the OAA, revised in 2006.
  • 340:105-10-38 is amended to update targeting language to comply with 2006 Reauthorized OAA revisions.
  • 340:105-10-40 is amended to clarify the request for proposal (RFP) process by deleting the requirement for State Agency approval for RFP packages with the exception that for-profit applications must be reviewed and approved by the State Agency.
  • 340:105-10-50.1 is amended to update the taxonomy to comply with 2006 Reauthorized OAA revisions deleting daily recommended dietary allowances (RDA) and expanding the definition of caregiver counseling services to include the areas of health, nutrition, and financial literacy.
  • 340:105-10-54 is amended to update language to comply with 2006 Reauthorized OAA revisions to supportive services including mental health screening and provision of assistive devices.
  • 340:105-10-71 is amended to comply with 21 O.S. § 1247, as amended that mandates all public facilities be smoke free and that such designation be posted.
  • 340:105-10-75 is amended to update language to comply with 2006 Reauthorized OAA revisions and to allow Form 02AG018E, Project Menu Plan – Nutrition Program for the Elderly, to be submitted quarterly to the area agency on aging instead of the State Agency Registered Dietitian (RD).
  • 340:105-10-90.1 is amended to comply with 2006 Reauthorized OAA revisions that update and clarify eligibility requirements for the National Family Caregiver Support Program (NFCSP) by revising the definition of a grandparent or older person who is a relative caregiver to include adoption and decreasing the eligible age of a grandparent or relative caregiver from 60 to 55 years. The amendment also clarifies NFCSP services available and adds caregivers who are older persons providing care to a person with severe disabilities including children with severe disabilities to the target population to be served.
  • 340:105-10-96 is amended to include health services (including mental health services) to the list of priority supportive access services to comply with 2006 Reauthorized OAA revisions.
  • 340:105-10-101 is amended to clarify the request for proposal (RFP) process by deleting the requirement for State Agency approval for RFP guide and grant application package with the exception that for-profit applications must be reviewed and approved by the State Agency.


EMERGENCY APPROVAL: Emergency rulemaking approval is requested as the proposed rules will allow for older persons to receive needed services, allow for improved representation of older persons on the State Council on Aging, and allow for smoke free Title III senior centers. Implementation of the proposed rules will bring the rules into compliance with federal law, which will have a positive impact on the health, safety, and well-being of the affected persons by expanding program eligibility.

AGENCY GOALS: The proposed rules achieve OKDHS goals by helping individuals and families in need help themselves lead safer, healthier, more independent, and productive lives.

COST:  The probable cost to OKDHS includes the cost of printing and distributing the rules, which is estimated to be less than $20.

SUMMARY: The proposed revisions to Subchapter 1 of Chapter 110 improves the program and services provided by the Oklahoma Department of Human Services (OKDHS) licensing field staff to child care facilities. The following rules were previously approved by the Commission and have been approved by the Governor under emergency provisions of the Administrative Procedures Act (APA). Substantive changes from the emergency rules are proposed, and are highlighted. The APA requires the Commission to again vote on the rules after the Notice of Rulemaking Intent is published in the Oklahoma Register and the public comment period expires. The comment period has expired on the following rules; no comment was received. The proposed permanent rules will be submitted to the Governor and Legislature for approval if approved by the Commission as permanent rules.

The following rules were previously approved by the Commission and have been approved by the Governor under emergency provisions of the Administrative Procedures Act (APA). The APA requires the Commission to again vote on the rules after the Notice of Rulemaking Intent is published in the Oklahoma Register and the public comment period expires. The comment period has expired on the following rules; no comment was received, and no substantive revision of the emergency rules is proposed. The proposed permanent rules are to be submitted to the Governor and Legislature for approval if approved by the Commission as permanent rules.

SUMMARY: The proposed revisions allow for increased health and safety requirements for children in licensed family child care homes and large family child care homes. Most critical revisions occur in the area of fire safety and qualifications of the primary caregiver. These revisions impact the daily environment where children are in care therefore improving the quality of care received and further insuring children’s safety. Revisions also allow for increased accessibility of licensing information for parents and the public.

PERMANENT APPROVAL:  Permanent rulemaking approval is requested.

AGENCY GOALS: The proposed rules achieve OKDHS goals by supporting and strengthening the family and protecting its members.

COST: The probable cost to OKDHS includes the cost of printing and distribution of the rules, which is estimated to be less than $20. Licensing staff will be trained utilizing existing state office staff assigned to this duty.

AUTHORITY: Commission for Human Services; Article XXV, Sections 2, 3, and 4 of the Oklahoma Constitution; and the Oklahoma Child Care Facilities Licensing Act, Section 401 et seq. of Title 10 of the Oklahoma Statutes.

EMERGENCY RULE APPROVAL DATE: WF 07-16 was previously approved as an emergency by the Commission on July 24, 2007 and by the Governor on Aug. 3, 2007.

Joni Burch with the OKDHS Developmental Disabilities Services Division presented a report on the DDSD Foster Grandparents Program on behalf of the OKDHS Office of Volunteerism.

Chief Operating Officer for Human Services Centers Marq Youngblood delivered a brief update to the Commission before introducing Area IV Director Bill Wilson and Area IV APS Liaison Curtis Rose who delivered a presentation on a partnership with the Choctaw Tribe/McCurtain County Choctaw Health Center.

Sharon Neuwald, coordinator, OKDHS Office of Legislative Relations and Policy, delivered a brief legislative report.
