The Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA)
USERRA is the federal law that establishes rights and responsibilities of the National Guard and Reserve and their civilian employers.
An employee returning from active military duty is entitled to the position previously held with DHS when active duty was:
- 90 days or less, the employee is returned to the position that the employee left; or
- 91 days or more, the employee is restored to a position with like seniority, status and pay.
